Recipe Passport: Terms of use

· See previous versions

Recipe Passport is made by Bounceback Studios (“we”, “us”), the registered business name of a sole trader in Australia, ABN 24 362 033 828. Contact: support@bouncebackstudios.app.

By installing or using Recipe Passport you agree to these terms. How we handle data is described in our Privacy policy: https://bouncebackstudios.app/recipe-passport/privacy.

1. Your rights come first

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, including the consumer guarantees, or under any other law that cannot be excluded, restricted or changed by agreement. That includes consumer protection laws where you live, including the Consumer Rights Act 2015 if you are in the United Kingdom. Every other part of these terms applies only to the extent the law allows, and if a part would take away one of those rights it does not apply to that extent.

2. The reader is a model: check what it writes

The app reads recipes with an automated language model that runs on your phone: a model file the app downloads or you import, or, on an iPhone or iPad with Apple Intelligence turned on, Apple’s built-in on-device model. Like any such model it makes mistakes: it can leave out, change or invent an amount, a unit, an ingredient, a step, a cooking time, a temperature or a unit conversion, and it can miss or add an allergen. The app’s own checks catch some of these, not all. Before you cook, compare the recipe with its original source (the link, video or text you imported) and don’t rely on the app’s version alone.

Take extra care with anything that affects food safety or health: cooking temperatures and times for meat, poultry, seafood and eggs; preserving, canning, fermenting and curing; allergies and intolerances; and any dietary or medical need. For these, check the original recipe, the product labels and a trusted food-safety source every time. The app can’t be relied on to find or flag allergens.

You decide what you cook, eat and serve, and you are responsible for checking a recipe before you do. The app is a tool for saving and organising recipes. It is not a source of cooking, food-safety, dietary or medical advice, and it is not a medical device: it does not diagnose, treat or prevent any condition. Nutrition figures are rough estimates, not a substitute for advice from a doctor or dietitian. This section tells you what to check; it does not take away any right described in section 1.

3. Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own personal, non-commercial use, as these terms and the store you got it from allow. The app, its design, text, code and the nutrition table it bundles stay ours or our licensors’. Open-source parts are listed in the app (Settings > About and support > About the developer > Open-source licences) and keep their own licences.

Please don’t copy, modify, reverse-engineer, resell or redistribute the app, remove its ads other than through the purchase it offers, or use it to break the law or anyone else’s rights, except as the law allows. If you seriously break these terms we may end your licence; you can stop using the app and uninstall it at any time.

4. Your recipes and other people’s content

Recipes you save stay on your phone unless you choose to share or send them, for example in a backup, a shared recipe or a problem report. Recipes, photos and videos made by other people belong to them: the app saves them for your private use and doesn’t change who owns them. Photos of cookbook pages you import with “From photos”, and the recipes read from them, are for your own private use only; the book’s text and pictures stay its publisher’s and authors’. You are responsible for what you import and share, and for having the right to do so. If you believe something in the app infringes your rights, email us and we will look into it.

5. Other sites and services

When you import a link, the app fetches the page, video captions or image you asked for from the site that hosts it, the way a browser would, and reads it on your phone. We are not affiliated with any website, video service or social network, we don’t control those sites, and their own terms apply to your use of them: you are responsible for following the terms of the sites and video services you import from, including YouTube’s. A site may change, block or stop answering the app at any time, and some import methods, such as reading a YouTube video’s captions, rely on endpoints that are not an official programme for apps and may stop working. Opening a recipe’s source link hands you to your browser or another app.

6. The recipe reader

The app can download a language model file from Hugging Face, when you choose to, or use one you import. The model is made by others and comes with its own licence, shown on its download page. We don’t control it, its download host or its availability. On an iPhone or iPad with Apple Intelligence turned on, the app reads recipes with Apple’s built-in on-device model instead, and no download is needed; Apple provides that model under its own terms, and we don’t control it or whether it is available on your device. Whichever model you use, section 2 applies to what it writes.

7. Ads and purchases

The app may show ads, served by Google AdMob, and offers a one-time purchase, “Remove ads”, that takes them away. It unlocks nothing else and there is no subscription. On Android you buy it through Google Play under Google’s terms, and it applies to your Google account. On iPhone and iPad you buy it through Apple’s App Store under Apple’s terms, and it applies to your Apple Account. “Restore purchases” on the Remove ads screen in Settings asks the store again. A purchase on one store does not carry over to the other.

Prices are shown in the store before you buy.

8. Refunds and consumer guarantees

If the app or a purchase doesn’t do what it should, you have rights. In Australia the app and “Remove ads” come with guarantees under the Australian Consumer Law that cannot be excluded, and you are entitled to a remedy from us if they are not met. Consumer laws where you live may give you similar rights.

The quickest way to ask for a refund is usually the store you paid through: Google Play (Order history in the Play Store app or at play.google.com) or Apple (reportaproblem.apple.com, or your purchase history in Settings). The store’s refund policy is in addition to your legal rights, not instead of them. If the store can’t help, or you would rather talk to us, email support@bouncebackstudios.app and we will sort it out with you.

9. Changes and the end of the app

We may change, update or remove features, change which sites the app can import from, and we may stop updating or supporting the app or remove it from a store. We won’t take away something you paid for without giving you reasonable notice in the app and, where the law requires it, a remedy such as a refund. Your recipes stay on your phone, and you can export a backup in Settings at any time. Your rights under the law and the store’s policies are not affected.

10. Our responsibility

Subject to section 1:

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.

11. App stores

Google Play. Google Play’s own terms and refund policy apply to downloads and purchases made there. Google is not a party to these terms.

Apple App Store. Apple is the seller of purchases made through the App Store, and Apple’s standard Licensed Application End User License Agreement also applies, and where it conflicts with these terms it governs the licence from the App Store. These terms are between you and us, not Apple. Apple has no obligation to maintain or support the app, and is not responsible for it, for any claim about it (including product liability, consumer protection, privacy or intellectual property claims), or for addressing your claims under these terms; if the app fails to meet a warranty Apple gives you, you may tell Apple and it may refund the price you paid, and that is Apple’s only warranty obligation. You confirm you are not in a country under a United States government embargo or designated as supporting terrorism, and not on a United States government list of prohibited or restricted parties. You must comply with any third-party terms that apply when you use the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms, for example when the app, the law or a store policy changes. We will mention important changes in the app’s “What’s new” before they apply, and we list every change, with the date, the app version it applies from and the full text of the earlier version, at https://bouncebackstudios.app/recipe-passport/privacy/changes/. A change never reduces your rights over something you already paid for. The current version is in the app (Settings > About and support > Terms of use) and at https://bouncebackstudios.app/recipe-passport/terms. If you don’t agree with a change, you can stop using the app and uninstall it at any time.

13. Age

The app is meant for people aged 18 and over. It is not meant for children, and we don’t knowingly let anyone under 18 use it.

14. Problems and disputes

If something goes wrong, please email us first and give us a reasonable chance to fix it; most problems are solved that way. Nothing here stops you using your local consumer protection body, a court or a tribunal, or any dispute resolution process the law gives you.

15. General

These terms are governed by the laws of the Australian Capital Territory, Australia, and the courts there have non-exclusive jurisdiction. If you live elsewhere, nothing here takes away the protection of the consumer law where you live or your right to bring a claim there. If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later. These terms, our Privacy policy and the store’s terms are the whole agreement between you and us about the app. You may not transfer your rights under these terms. Support is by email, on a best-effort basis.
